Given that the mold is clearly made with Overlord in mind first... yeah, it'll no doubt be released as Overlord. Still, their releasing an already-used mold as an exclusive isn't exactly unheard of.

Yeah, like Armada Megatron. They could release the skyshadow mold in DaiAtlas colours as a toy show exclusive. Or even part of the main line, as they did with Soundwave.

Just thought I'd share exciting news about a possible Tokyo Toy Exclusive Legends Black Convoy listing I received from my local toy supplier. Its supposed to retail at ¥5,600 to be avaliable for release at the end of June 2017. Ive included a screenshot of the email sent as proof.

Not naturally, though. Brave Maximus was created by Primus/Vector Sigma on Earth in ancient times. Towards the end of what we're shown of his life, he ends up being sent back in time from 2007 and crash-landing on Planet Master, where he becomes the inspiration for Fortress's Headmaster technology.
